Restore Crossing Guards:

•  To: City Council

As school is about to begin I would like to recommend restoring Crossing Guards to our City Budget.   This can be classified seasonal work and no unemployment benefits can be made against the City of Lackawanna .   After talking with our Public Safety Director, he advised me the checker position can be eliminated and taken over by the Police Lieutenant on duty.   We would transfer $69,120 from the General Fund to code A3120.106.   I am asking for your support to restore the Crossing Guards to protect our children in our City.

request the Council to place a 12 month moratorium on selling City owned property until a work session can be scheduled with us to discuss ways of recouping funds spent on demolition and maintenance of these properties.

Intent to Retire Credits-Ken Brown:

Based on case law holding the decision of the State Comptroller on local decisions regarding pensions and pension rights of New York State   Public Employees Retirement System the decision of the New York State Comptroller regarding the credits of Kenneth Brown at more than 20 years prevails. Therefore, the attached resolution is requested to resolve the conflict.

Kenneth Brown Retirement Retirement-Resolution 26, 2010:

RESOLVED,    that the New York State Comptroller decision in approving the retirement application of Kenneth Brown certifying more than 20 years continuous service credit with the City of Lackawanna, excluding the 3 year incentive credit allowed by the State of   New York, is controlling on the City of Lackawanna and he is therefore entitled to his City retirement incentive and all his retirement benefits as a 20 year employee as provided in it's local union's Collective Bargaining Agreement with the City.

AN ORDINANCE AUTHORIZING THE SALE/TRANSFER OF PROPERTY   PURSUANT TO MUNICIPAL CODE SECTION 107.

            BE IT ENACTED by the City Council of the City of Lackawanna, New York as follows:

            SECTION 1.   That the City Council hereby approves of the transfer of property known as SBL 142.45-4-37.

            SECTION 2.   That the transfer is made for the sum of $10,100.00 cash to the City of Lackawanna .   The deed shall contain a reverter clause providing for a reversion to the City unless the deed is recorded in the Erie County Clerk's Office  within 30 days of its delivery.

            SECTION 3.   That the purchaser/transferee shall be responsible for expenses related to the transfer other than those specifically belonging to the City of Lackawanna .

            SECTION 4.   That the Law Department shall prepare documents to be executed for the transfer of the property.

Budget Amendment-Crossing Guards:

            AN ORDINANCE AMENDING THE 2010-2011 BUDGET ADOPTED

              JUNE 1, 2010.

BE IT ENASCTED, by the City Council of the City of Lackawanna, New York as follows:

SECTION 1.   That the 2010-2011 Budget Ordinance adopted June 1, 2010 is hereby amended to provide the funding for Crossing Guards.

SECTION 2.   That the 20910-2011 Budget Ordinance is hereby amended to add $69,120 to budget code A3120.106 Police Department.

SECTION 3.   That the 2010=2011 Budget Ordinance is hereby amended to appropriate $69,120 of the City's Fund Balance.

Local Law # 6, 2010

Local Law to adopt the 2010 Retirement Incentive Program

Part B – Chapter 105, Laws of 2010

A Local Law electing a retirement incentive program as authorized by Chapter 105, Laws of 2010 for the eligible employees of the City of Lackawanna .

BE IT ENACTED by the City Council of the City of Lackawanna, New York as follows:

•  The City of Lackawanna hereby elects to provide all of its eligible employees with a retirement incentive program authorized by Chapter 105, Laws of 2010.

•  The commencement date of the retirement incentive program shall be 8/2/2010.

•  The open period, during which eligible employees may retire and receive the additional retirement benefits, shall be October 1, 2010 to December 29, 2010.

•  The actuarial present value of the additional retirement benefits payable pursuant to the provisions of this local law shall be paid as one lump sum, or in five annual installments.   The amount of the annual payment shall be determined by the Actuary of the New York State and Local Employees' Retirement System, and it shall be paid by the City of Lackawanna for each employee who receives that retirement benefit payable under this local law.

•  This act shall take effect 8/2/2010.
