Regular session of the Lackawanna City Council met in the Council Chambers, Council President Chuck Jaworski presiding.   The meeting was preceded by the Pledge of Allegiance led by Council President Jaworski.

Approval of Minutes

Moved by Schiavi, seconded by Jaworski to adopt minutes of regular meeting of August 11, 2008 as written.

Communications from the Mayor:

CDBG Funds – Demolition of Buildings

To: City Council

I request your honorable body grant me authorization to enter into a contract with the County of Erie and request $160,000 in CDBG funds to be used for demolitions.

Lackawanna Soccer Team – Use of Stadium

To:   City Council

In the spirit of cooperation I am requesting the Council approve the use of Veterans Stadium to the Lackawanna High School 's soccer team for five afternoons and one evening game. This is due to the fact that their field is being disrupted by the paving at the high school.

Moved by Jaworski, seconded by Szymanski to approve request, school is to provide security, lining of the field and cleanup of the stadium after the games.

Bid for grant writers

To: City Council

I would like to authorize our City Clerk to advertise for bids for grant writers for the City of Lackawanna .

Executive Session Minutes

According to NYS Public Officers Law, minutes must be taken at executive session. I ask for a copy of the minutes accordingly.

Stop Sign –Mill on Steelawanna

Requests a stop sign at Mill on Steelawanna, north and south sides.

Transfer of Funds – Negotiations Account

To: City Council

Requests approval to transfer funds from the Reserve for Negotiations account Code A1931 into various payroll accounts for fiscal year ended July 31, 2008.

Travel Request – Empire Zone Director

Seeks Council approval to attend the 2008 Empire Zone Conference in Schenectady , New York from October 6 -7, 2008.

Budget Amendment – Police Communication Center

To:   City Council

Purchase orders have been issued in regards to the renovation of the Police communications area. In order to account for the project it will be necessary to amend the 2007-08 budget.

Travel Request – City Assessor

Seeks approval to attend the NYS Assessors Annual Seminar on September 21 – 24, 2008. Funds available in Assessor budget.

Assessment & Review Board Vacancy

To: City Council

Advises the Council that a vacancy will arise in the Assessment & Review Board due to John Tiberio's term expiring on September 30, 2008.

Parking on Franklin – Sunflower Apartments

To:   City Council

The Fire department is having difficulty with the on street parking next to the Sunflower Apartments at 146 Franklin .   Cars parked are preventing access to the building and limiting evacuation routes. Fire trucks are forced to park in the street blocking traffic and preventing proper hose lays in the case of fire.   I request an ordinance enforcing the east side of Franklin from Orange to appoint past the driveway entrance to the apartments be made a no parking zone. Also, a no parking zone on the south side of Orange from Franklin to a point past the driveway entrance to the apartments.

Permission to address Council

Seeks permission to address the Council regarding the flooding problem on Willet road.

Resolutions:

PBA Contract

Resolution #35, 2008

Resolved, that the labor relations contract negotiated between the City of Lackawanna and the Lackawanna Police Benevolent Association for calendar years 2006 through July 31, 2009 be and the same is hereby approved and the Mayor authorized to execute same.

THIS RESOLUTION SHALL TAKE EFFECT IMMEDIATELY.

Ordinances

Police Communications Area

An ordinance amending the 2007-08 budget adopted on June 8, 2007 to add $150,000 to budget code   A3120.0443, repairs and equipment.   The budget ordinance is hereby amended to appropriate $150,000 of the city's fund balance.

THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY.

Moved by Jaworski, seconded by Szymanski to remove from the table, item from August 11, 2008 meeting, sale of property to Donna Bandich.

Yeas:   Haxton, Szymanski, Kulczyk, Schiavi, Jaworski.         Carried   5 - 0

Moved by Szymanski, seconded by Haxton to approve the sale of property located adjacent to Donna Bandich residence at 87 Roland for sum of $500, city attorney to prepare ordinance.

Moved by Jaworski, seconded by Szymanski to remove from the table, item #29, meeting of August 11, 2008 – contract for O'Connell & Associates grant writers.
