Regular Session of the Lackawanna City Council met in the Council Chambers, Council President Chuck Jaworski presiding.   The meeting was preceded by the Pledge of Allegiance led by Council President Jaworski.

  Traffic Signal @ Abbott & North Dr.:

                    To:       City Council

On June 26 th , 2009, I submitted a letter to your Honorable Body requesting that a green arrow traffic signal be added to the existing traffic signal at Abbott Rd. and North Dr . At that time the City Council approved this action.   This has been over a year and no action was taken on the matter to have this completed. At this time I request that the City Council put this job out to bid, so this installation can be completed.   Submitting this for your approval. Thank you.

Sale 31 South Street:

                     To:       City Council

My office has received two offers for the above mentioned parcel from Lackawanna Islamic Mosque of 154 Wilkesbarre Ave. and the First Baptist Church at 320 Ingham Ave. in the amount of $5,700.   They will be purchasing the entire lot which is 9.1 (A) with an assessed value of $20,000.   The Islamic Mosque would be using the parcel for a cemetery while First Baptist Church would be using it for new construction.

Sale 507-511 Ridge Road:

                     To:       City Council

My office has received an offer for the above mentioned property from Anthony Catuzza of   21 Beach St. , in the amount of $4,500.   The parcel is approximately 84 x 150 the purchaser will be converting the property into apartments and parking lot.   The current assessed value for the 2010 Tax Roll is $55,100.   The property is structurally sound and dry but is going to require extensive repair before occupancy can be given.   It is my recommendation that the City Council NOT SELL the property to Mr. Catuzza for the sum of $4,500 the price should be at least 30% of the assessed value or $16,500.

Sale of 17 Cooke Street :

                    To:       City Council

My office has received an offer for 21 Cooke St. SBL#142.45-1-7 from Stanley Susz of 17 Cooke Street in the amount of $900.   The parcel is approximately 32 x 124 the purchaser will extend his yard.   The current assessed value for the 2010 Tax Roll is $3,900.   It is my recommendation that the Council SELL the property                        to Stanley Susz for the amount of $900.   If approved by the Council buyer shall be liable for all fees and cost of survey.

Resolutions:

Marshiselli Program:        Resolution No 37, 2010

            Authorizing the implementation and funding in the first instance 100% of the Federal-Aid and State “Marchiselli Program-Aid eligible costs of a Transportation Federal-Aid project and appropriating funds thereof.

WHEREAS, the project for Roadway and Signage Improvements on Ludel, Sandra. Della, Shannon and Josie Streets, in the City of Lackawanna, Erie County, Pin5757.73 (the project) is eligible for funding under Title 23 U.S. Code, as amended, that calls for the apportionment of the costs such program to be borne at the ratio of 80% Federal Funds and 20% Non-Federal funds; and

WHEREAS, the City of Lackawanna desires to advance the Project by making a commitment of 100% of the Non-Federal share of the costs of the Construction & Construction Inspection phase of the Project, PIN5757.73.

NOW, THEREFORE, the Common Council of the City of Lackawanna , duly convened does hereby

RESOLVE, that the Common Council of the City of Lackawanna hereby approves the above project; and it is hereby further

RESOLVED, that the Common Council of the City of Lackawanna hereby authorizes the City of Lackawanna to pay in the first instance 100% of the Federal and Non-Federal shares of the cost of the Construction & Construction Inspection Phase of the Project or portions thereof; and it is further

RESOLVED, that the sum of $310,000 has been appropriated via City Resolution No. 29 adopted on July 7, 2008 and made available to cover the cost of participation in the above phase of the Project; and it is further

RESOLVED, that in the event the amount required to pay in the first instance 100% of the Federal and Non-Federal shares of the cost of the project's Construction & Construction Inspection phase exceeds the amount appropriated, $310,000 and/or 100% of the full Federal and Non-Federal shares of the cost of the project's Construction &   Construction Inspection phase   exceeds $615,000, the City of Lackawanna shall convene its Council as soon as possible to appropriate said excess amount immediately upon notification by the NYS Department of Transportation thereof, and it is further

RESOLVED, THAT THE Mayor of the City of Lackawanna is hereby authorized to execute al necessary Agreements, certifications or reimbursement requests for Federal Aid and/or Marchiselli Aid on the advancement or approval of the Project and providing for the administration of   the Project and the municipality's first instance funding of project costs and permanent funding of the local share of Federal-Aid and State-Aid eligible Project costs and all Project costs within appropriations therefore that are not so eligible, and it is further

RESOLVED, that a certified copy of this Resolution be filed with the NYS Commissioner of Transportation by attaching it to any necessary Agreement in connection with the project, and it is further

RESOLVED, this resolution take effect immediately.

  Sale of 21 Cooke St. - Stanley Susz:

              Ordinance authorizing sale/transfer of property pursuant to Municipal Code 107

            BE IT ENACTED by the City Council of the City of Lackawanna, NY as follows:

SECTION 1. That the City Council hereby approves of the transfer of property known as SBL142.45-1-7 a parcel approximately 32 feet by 124 feet to Mr. Stanley Susz.

SECTION 2. That the transfer is made for the sum of $900 in cash to the City of Lackawanna .

SECTION 3. That he purchaser/transferee shall be responsible for expenses related to the transfer other than those specifically belonging to the City of Lackawanna .

SECTION 4. That the Law Department shall prepare documents to be executed for the transfer of the property.
